Can a probation violation hearing consider constitutional problems?

If it is unconstitutional to enforce an ordinance against someone because it will cause them personal hardship that outweighs public harm (for example forcing them to do construction they cannot afford) then can this be raised at a probation violation hearing? At the time of sentence, 3 years ago, the economy was not as bad as it is now. So can it be raised now at a pv hearing?
